The Article 4 direction and what it means for you

Across most of England, converting a family home into a small HMO for three to six unrelated occupants is permitted development. You change the use from Class C3 to Class C4 without asking anyone. Trafford removed that right.

Trafford Council confirmed a borough wide Article 4 direction covering small HMOs, and it took effect on 21 December 2017. Trafford Council lists the control of houses in multiple occupation as one of the two purposes for which it operates Article 4 directions in the borough. Two national exceptions still apply:

  • Established use. A property lawfully operating as a small HMO before 21 December 2017 retains that use, provided it has not since been returned to single family occupation. Ask for the evidence in writing before you exchange.
  • Large HMOs. Any HMO housing seven or more occupants is sui generis under the Town and Country Planning (Use Classes) Order 1987 as amended. It has always required full planning permission everywhere in England, so the Article 4 direction changes nothing for it.

Applying for planning permission in Trafford
